Terms of Service
These terms govern use of Kinematum, including KinemaCoach, KinemaTalent, client workspaces, secure participant links, movement analysis, and generated training guidance.
1. Acceptance and account authority
By creating an account or using the professional workspace, you agree to these terms and confirm that you may bind yourself or your organization. An invited participant does not need to create an account or complete a separate in-app consent ceremony. The inviting organization remains responsible for giving the required notices and obtaining a valid consent or other lawful basis before creating the link.
2. Participant eligibility
KinemaCoach and KinemaTalent do not impose participant age limits. The inviting organization remains responsible for required notices, consent, and professional review. Do not use the service where local rules, professional standards, or organization policies prohibit it.
3. Intended use and important limits
Kinematum supports professional judgment and sport exploration. It is not medical advice, diagnosis, emergency care, biometric identification, or a prediction of sporting success. KinemaTalent must never be used to select, rank, exclude, employ, insure, admit, or otherwise make a high-impact decision about a person.
Each sport receives a bounded recommendation score combining interests, practical access, reference-backed body fit, and non-diagnostic posture readiness. This is not a universal score for ranking people and must never be the sole basis for selection or exclusion.
4. Organization and professional responsibilities
Before sharing a participant link, the inviting organization must provide an understandable privacy notice, explain the purpose and limitations, obtain and document any consent required by law, and provide a practical way to refuse or withdraw without disadvantage. The organization must retain its offline consent record for the legally required period.
Professionals must keep participant details accurate, use secure devices and accounts, review every result before sharing it, respond to safety concerns, and refer the participant to a qualified healthcare professional when appropriate.
5. Participant intake and image capture
A secure link lets the participant provide limited context, height, and five guided full-body photos. Photos are checked on the participant’s device before private upload. The participant may leave and resume while the link remains valid, retake a photo, close access, or request deletion through the link.
Only JPEG, PNG, and WebP images within the displayed size limit may be uploaded. Do not include another person, identity document, sensitive background material, or content you do not have permission to provide.
6. Automated processing and human review
The service applies Kinematum's confidential 96-point assessment method, evidence rules, and scoring rules, and may use configured AI services for bounded preparation choices. The configured AI does not write narrative prose. It receives only temporary sport identifiers such as sport_01; allowlisted identifiers for matched or missing preference and practical-access categories; and allowlisted identifiers for body-metric categories and high-level, non-diagnostic posture-preparation bands, focus regions, and screening indicators. It selects only bounded preparation-focus and trial-emphasis options, and the server composes the final narrative from approved localized templates. It does not receive raw photos, names, email addresses or other direct identifiers, exact height, coordinates, landmarks, or proprietary method details. Automated output can be incomplete or wrong. Every Talent result remains unavailable to the participant until a qualified professional reviews and approves it.
Reference data, scoring policy, limitations, and the result revision are preserved for traceability. Automated narrative output cannot add, remove, or reorder the selected sports.
7. Secure links, acceptable use, and suspension
Secure links are confidential bearer credentials. Do not publish, forward, scrape, probe, reverse engineer, disrupt, bypass limits, upload malicious content, or attempt access to another organization’s data. We may expire a link, suspend an entitlement, or restrict an account to protect participants, the service, or comply with law.
8. Content, feedback, availability, and changes
You retain rights in content you lawfully provide and grant Kinematum the limited permission needed to host, process, secure, and return it as part of the service. Do not submit content that infringes another person’s rights. Participant content and trial feedback are not used to train or fine-tune KinemaTalent models.
Service features may change, pause, or be withdrawn. We do not promise uninterrupted service or a particular outcome. To the extent allowed by law, the service is provided as available and professional decisions remain the responsibility of the qualified person and organization making them. Material changes to these terms will be dated and communicated through the service where appropriate.
9. Questions and concerns
For questions, privacy requests, or concerns about these terms, contact privacy@kinematum.com. If you joined through a trainer or organization, you may also contact that organization directly.
